How exactly does a dog "get loose" from a backyard? Dogs--to my knowledge--unlike deer or cats don't jump over fences. Did a human being open the gate and let the dog out? Or maybe the dog is smart enough to open the gate itself, and the human owner did not bother outwitting the dog. In either case, one would hope that this is going to court, and that the owner (or his insurance company) will wind up paying.
